In the name of God Amen, the two and twentieth daie of September in the yeare of our Lord God One thousand sixe hundred thirtie two And in the eighth yeare of the Raigne of our Soveraigne Lord Kinge Charles I John Ayhurst of Bread in the Countie of Sussex yeoman being sicke and weake in bodie but of good and perfect remembrance (I praise God for it) doe ordaine and make this my last will and testament in maner and forme following (that is to saie) First and above all thinges I committ and commend my soule into the hands of Allmightie God assuredly trustinge through the merrittes of Jesus Christ that it shalbe eternally saved And my bodie I comitt to the earth to bee christianly buried where it shall please God that I die Item I give unto the poore people of the p[ar]ish of Bread the some of tenne shillings of lawfull money of England to be paid by my Executor hereafter named to the Overseers for the poore there and by them to be distributed It I give and bequeath unto Elizabeth Ayhurst my now wife the some of fortie pounds of lawfull money of England to be paid unto them [sic] by my Executor hereafter named in lee and considerac[i]on of all her thirds or right of dowre out of all my lands and tenements in the parish of Catsfeild in the Countie of Sussex // the said money to be paid unto her in maner and forme following (that is to saie) twentie pounds thereof within six moneths of the death and decease of mee the said John Ayhurst and the other twentie pounds thereof within twelve moneth after the death and decease of mee the said John Ayhurst Alsoe I give and bequeath unto the said Elizabeth my now wife All my housholdstuffe whatsoever which I now have or am owner of (exceptinge one bedd and boulster that is in the house where I now dwell and one chest of lynnen which is in the house of one Richard Fuller my brother in lawe All which I give unto Susan my daughter and if she die before she come of full age then I give it to my wife and to be kept in the meane tyme the bedd and the boulster with my wife Item I give and bequeathe unto Thomas Chase my brother in lawe five pounds of lawfull money of England to be paid unto him by my Executor hereafter named within* [inserted in the margin] ^ * three monethes next after my decease Item I give & bequeath unto Susan Ayhurst my daughter xls yearly & everie yeare for ^ the tearme of eight yeares next after my decease if my mother Susan Ayhurst soe longe doe live and duringe the tyme of her life for and towards her educac[i]on and maintena[N]ce the said money to be paid quarterly at the fower most usuall feasts or termes in the yeare by mine Executor hereafter named unto Thomas Chase my brother in lawe or to any other with whome Susan Ayhurst of Bread in the Countie of Sussex widow shall thinke fitt dureinge her life to place the said Susan my daughter And if it shall happen the said Susan Ayhurst to die and depart this life before the end and expirac[i]on of eight yeares as is aforesaid after my decease And yf it happen ^ I ^ the said John Ayhurst have a child borne by Elizabeth my now wife then Richard Fuller my Executor hereafter named to make an accompt unto my said Childs benefitt of the said fortie shillinges a yeare for soe long tyme as it shalbe unpaid by the death of Susan as aforesaid and also of the remainder of my personall estate he being allowed fower pounds and fowerteene shillinges which I stand bound to paie [word deleted] my mother Susan Ayhurst by my bond and beinge allowed my funerall expences my debts if I shall owe any and my legacies and such necessarie charges as he shall lay out or expend about my busines concerninge this my will first deducted And I doe ordaine the said Richard Fuller of Bread in the Countie of Sussex my brother in lawe sole Executor of this my last will and testament givinge unto him all the residue of my goods Cattell and Chattells whatsoever not before bequeathed or given he discharginge my funerall expences and payinge my debts and legacies and givinge an account of the remainder thereof after the death of Susan my mother And I doe renounce revoke disanull and make voide hereby any former wills by mee made and declare this to be my last will and Testament In witnes whereof I have hereto sett my hand and seale dated the daie and yeare first above written John Ayhurst his marke Sealed and delivered in the presence of Ed. This is also the last will and Testament of mee the abovesaid John Ayhurst concerning all my messuages lands and tenements whatsoever First for my messuage lands and tenementes lyinge in Bourne in the Countie of Sussex now in the tenure or occupac[i]on of one Thomas Moser or his assignes my will and minde is that Susan my daughter and her heires shall have hold and enioy all those w[hi]ch were her mothers by the gift of George Foord Grandfather of the said Susan accordinge to his gift And as touchinge all my messuage lands and tenementes in the parish of Catsfeild in the Countie of Sussex now in the tenure or occupac[i]on of [blank] Dulvie or of his assignes I give and bequeath them unto Richard Fuller my Executor and his heires for and duringe the naturall life of Susan Ayhurst of Bread in the Countie of Sussex wid[ow] my mother upon speciall trust and confidence that he the said Richard Fuller out of the rentes & profittes thereof shall paie unto the said Susan my mother the some of fower pounds and fourteene shillinges due unto her by my bond And from and after the death and decease of the said Susan Ayhurst my mother all and every the said messuage lands and tenementes to any such child as shalbe borne of the bodie of Elizabeth Ayhurst my now wife of my bodie begotten and to the said Child his or her heires forever lawfullie to be begotten And for want of such issue if the said Elizabeth my ^ nowe ^ wife be not with Child by mee at my death then I give and bequeath the said messuage lands and tenem[en]tJohn Ayhurst unto Susan Ayhurst my daughter and the heires of her bodie lawfullie to be begotten for ever And for want of such issue then I give and bequeath the said messuage lands and Ten[emen]tJohn Ayhurst unto my friends John Tihurst of Heathfeild in the Countie of Sussex yeoman and John Chilley of Heathfeild aforesaid yeoman their heires and assignes forever upon speciall trust and confidence and upon condic[i]on that they the said John Tihurst and John Chilley or the survivor or survivors of them the heires or // assignes of them or either of them shall within six moneths next after that the land shall come unto them for want of issue as abovesaid make sale of all and every the said messuage lands and ten[emen]tJohn Ayhurst to the most and best value they cane and out of the monie so made or arising shall paie and satisfie or cause to be paid and satisfied unto William Ayhurst Thomas Ayhurst and Richard Ayhurst brethren of mee the said John Ayhurst the moitie or one halfe of all such monie as thereof shall arise or be made equallie to be devided betweene them out of the moietie or other halfe of the said monie made as aforesaid shall pay and satisfie or cause to be paid and satisfied unto Anne Byne the wife of William Byne of Burwash & her Children five pounds of lawfull money of England And unto the three daughters of John orrice my uncle deceased sixe pounds to be equallie devided betweene them out of the said money and the residue or remainder thereof unto Susan Ayhurst the now wife of mee the aforesaid of the said money the moity or one halfe alsoe with the remainder upon account of the personall estate if the Children and theire issue die as abovesaid to be equallie devided and paid or cause to be paid in maner and forme followinge that is to saie one third part therof unto Elizabeth Ayhurst the now wife of mee the aforesaid John Ayhurst the testator and one third part to Anne the wife of Thomas Chase and her Children and th’other third p[ar]te unto Mary the wife of Richard Fuller and her Children In witnes whereof I hereunto sett my hand and seale and doe publish and declare this to be my last will and testament concerninge my lands and messuage and ten[amen]tJohn Ayhurst dated the daie and yeare first abovewritten John Ayhurst his marke Sealed and delivered in the presence of Ed.
