I John Elliott the elder of Rotherfield In the county of Sussex yeoman being in good and perfect memory do make ordain and declare this my last will and testament in manner and form following.
Imprimis I give and bequeath my soul to God my Creator and my body to be buried in the earth at the discretion of my Executors hereafter named
Item I give and bequeath to the poor People of the parish of Rotherfield the sum of four pounds to be divided amongst them at the discretion of my Executors hereafter named within three months in or after my decease
Item I give and bequeath unto John, Alexander, Richard and Matthew sons of my son Obadiah Elliott and unto Mary and Elizabeth daughters of my said son Obadiah the sum of ten pounds apiece, to be paid to them at their natural ages of one and twenty years. And If either of the said children of my said son Obadiah shall happen to die before he or she shall accomplish the age of one and twenty years then my very will and meaning is that the said ten pounds which should have been paid to him or her for dying shall remain and be equally divided amongst all the other children of my said son Obadiah to be paid to them at their natural ages of one and twenty years.
Item I give and bequeath unto John Alexander and Marie children of my son Alexander Elliott the sum of ten pounds apiece to be paid to them when they shall accomplish his or her age of one and twenty And If any of the said children of my said son Alexander shall happen to die before he or she shall accomplish the age of one and twenty years then my will and meaning is that his or her part remain and be equally divided among all the rest of the children of my said son Alexander to be paid unto them at their natural ages of one and twenty years.

Item I give and .bequeath unto Gregorie Richard Alexander Elizabeth Marie and Alice children of my daughter Joane Rose deceased late wife of George Rose the sum of ten pounds apiece to be paid to them at their natural ages of one and twenty years. And if any of the said children of my said daughter Joane Rose do happen to die before he or she so dying shall accomplish his or her age of one and twenty years then my very will and meaning is that his or her part or portion for dying shall remain and be equally divided amongst all the other children of my said daughter Rose to be paid to them at their natural ages of one and twenty years.
Item I give and bequeath unto Mary, Katherine, Joan and Elizabeth daughters of my daughter Mary Merchante the sum of twenty pounds apiece to be paid unto them at their natural ages of one and twenty years. And if any of the said daughters of my said daughter Merchante do happen to die before she for dying shall accomplish her age of one and twenty years then my very will and meaning is that her part for dying shall be and remain and shall be equally divided amongst all the residue of the said daughters of my said daughter Merchante to be paid unto them at their natural ages of one and twenty years.
Item I give and devise unto my said daughter Marie Merchante the sum of thirty pounds to be paid to her within six months next after my decease and I give and bequeath unto the said Mary Merchante all the wearing apparel of my late wife deceased. Item I give and bequeath unto Obadiah Elliott my son the sum of two hundred and fifty pounds to be paid to him in manner and form following viz the sum of one hundred and twenty five pounds parcel thereof within six months next ensuing after my decease and the sum of one hundred and twenty five pounds residue thereof within one year next ensuing after my decease. And if my said son Obadiah happen to die before the said sum of two hundred and fifty pounds shall be paid to him as aforesaid then I will the sum of two hundred and fifty pounds or so much thereof as shall be then unpaid to and amongst all the children of the said Obadiah if he had lived.
Item I give and bequeath unto William Elliott my son the sum of three hundred pound unto be paid to him in manner and form following viz the sum of one hundred and fifty pounds parcel thereof within six months next after my decease and the sum of one hundred and fifty pounds residue thereof within one year next ensuing after my decease. And if my said son William Elliott happen to die before the said sum of three hundred pounds shall be paid to him as aforesaid then I will the sum of three hundred pounds or so much thereof as shall be then unpaid to and amongst all the children of the said William my son to be paid equally among them at such times as the sum should have been paid to the said William if he had lived.
Item I give and bequeath unto William Beart my servant the sum of twenty shillings.
Item I give and bequeath unto William Gourd and Annie Gourd my servants the sum of ten shillings apiece.
Item I give and devise unto Anne Kennett my servant the sum of twenty shillings and my very will and meaning is that the said natural legacies to the said William Beart, William Gourd, Annie Gourd and Anne Kennett my servants shall be paid unto them within two months next after my decease and tht and acquittances under their or either of their hands given unto my executors of either of them shall be a sufficient charge to my executors for the sum.
And my executors shall forever after be acquitted of such legacies so acquitted and provided all monies and my very will and meaning is that if the said George Rose late husband of my said daughter Joane Rose do any time hereafter do molest or trouble my executors or either of them or the executors or administrators of my said executors or either of them or for or concerning any legacy given or demnified to the said Joane his late wife by the last will and testament of Alexander Ellott als Elliott my brother deceased then the said natural stipends of ten pounds apiece by this my will Gregorie Richard Alexander Elizabeth Marie and Alice the six children of my said daughter Rose and the legacy of five pounds given by this my said will to him the said George Rose shall be utterly void.
Item I give and bequeath unto Richard and Luke the two sons of my own daughter Merchante the sum of ten pounds apiece to be paid to them when they shall achieve their natural age of one and twenty years and if either of the said children shall happen to die before they shall accomplish the natural age of one and twenty years then his part for dying shall remain to the other of them which shall survive to be paid to him at his age of one and twenty years.
And I do ordain and make my sons John Elliott and Alexander Elliott sole executors of this my last will and testament and my very will and meaning is that what monies soever shall be owing to me by my said executors or either of them at the time of my decease shall be by them accounted in my inventory as part of my personal estate.
This is the last will and testament of me the said John Elliott made and declared the day and year above said for touching and concerning the disposition of my lands and tenements.
Imprimis I give and devise unto my son William Elliott and his heirs and assigns forever all that messuage tenement and lands situate lying and being in Warbleton in the said County of Sussex called or known by the Bucksteep or being part of Bucksteep containing in the whole by one hundred and twenty acres with all singular lands tenements and appurtenances thereunto belonging now in the occupation of the said William Elliott or his assigns.
In witness whereof I the above written John Elliott his mark signed salad published and declared to be the last will and testament of the said John Elliott in the presence of John Maynard junr Thomas M… Henry Boorne, Thomas Weller.
