William Brayn Indicted, for that he, the 6th. of Septemb. 1678. did steal one Gelding, colour brown , from Ambros Galloway . He pleaded Not guilty, and put himself upon the Countrey.
William Brayn, for stealing a Gelding from Ambros Galloway; against whom
One testifi'd his knowledge, that it was Ambros Galloways Horse; and another, that he bought it of the Prisoner. But Ambros himself, being a Quaker, would not, for Conscience-sake, as he said, swear, and so could give no testimony about his losing him. Upon which the Court directed the Jury to find the Prisoner Not guilty for want of Evidence, and committed the Quaker, as a concealer of Felony, for refusing an Oath to Witness for the King.

I Ambrose Galloway the Elder of Lewes in the County of Sussex being aged and infirme in body but of a sound pfect and disposing mind and memory doe make and declare this to be my last will and testament in manner & forme following First I commend my soule into the hands of Almighty God my Creator who hath given me large[?] experience of his tender Love and Compassion toward me his poor Creature, not for any meritt or defect of mine but thro’ his never failing mercy in his only sonn Jesus Christ the alone Mediator for man who workes all good workes in us & for us And to whom be all honor & glory forever And my body I yield to the Earth to be buryed according to ye discretion of my Executor And as for my worldly goods and estate which God of his mercy hath lent me I dispose of them as followeth
Imprimus I give and devise unto my sonn Ambrose Galloway all my messuages lands and tenemts whatsoever and wheresoever To have and to hold to him and his heirs forever
Item I give and bequeath unto the three children of my said sonn Ambrose Galloway viz Ambrose William and Elizabeth Galloway the sume of thirty pounds apiece to be payd unto them as they respectively attaine and come to their ages of one and twenty years by my Executor hereafter named, upon condition they continue dutifull and obedient to their parents and not otherwise
Item I give and bequeath unto my daughter in law Ruth Galloway some small peeces of old gold now lying in my boxe
Item I give to ye poor of ye parishe of All Sts in Lewes the sume of twenty shillings to be distributed amongst them within one month after my decease

In the Name of God Amen I Ambrose Galloway of Lewes in the County of Sussex Merchant, being in declining state of body but of sound and perfect mind and memory (praised be God) do make and ordain this my last will and testament in writing First and principally I commend my soul into the hands of Almighty God hoping for eternal salvation through the merits death and passion of my blessed Saviour and Redeemer Jesus Christ and my body I commit to the earth to be decently buried at the discretion of my executor hereafter named, and dispose of such worldly estate wherewith it hath pleased God in mercy to bless me as follows viz. I charge all and singular my freehold and copyhold messuages mills buildings gardens orchards lands tenements and hereditaments whatsoever with their and every of their appurtenances situate lying and being in the several parishes of Barcomb, St Thomas in the Cliffe near Lewes, All Saints in Lewes, and Haylsham or in any or either of them or elsewhere in the said county of Sussex, whereof I shall be seized at the time of my death with the payment of one annuity or rent charge of £50 per annum (including taxes) unto my most dear and loving wife Ruth and her assigns during the term of her natural life, which said annuity I direct shall be only paid to my heir at law by equal half yearly payments viz. at the feast of Saint Michael the Archangel and the Annunciation of the Blessed Virgin Mary and that the first payment thereof be made on the first of the said feasts as shall next happen after my decease And Whereas I am indebted unto my dear and loving daughter Elizabeth Galloway for monies of hers in my hands in the sum of £200 now I do hereby give and bequeath unto my said daughter the sum of £1000 of lawful money of Great Britain over and above the said sum of £200 which I owe her as aforesaid to be paid her by my executor hereafter named in manner following (that is to say) £500 part thereof within six months after my decease and the other £500 within six months after the death of my said dear and loving wife All and singular the rest residue and remainder of my goods chattels stock household stuff plate linen and personal estate whatsoever (my debts legacies and funeral expenses being first fully satisfied and discharged) I give and bequeath unto my most dear and well beloved son Ambrose Galloway whom I make and ordain sole and whole executor of this my will And whereas I have herein before charged all my real estate with the payment of the said annuity of £50 per annum to my said wife during her natural life Now I hereby declare that my will and mind is that the same is so given her on condition that she make no other claim to my real estate or any part thereof, which if she at anytime hereafter do or cause or permit to be done that the said annuity shall from thenceforth cease and be no longer payable, anything herein before contained to the contrary thereof notwithstanding And lastly I revoke and make void all former wills by me made In Witness whereof I have to this my last will and testament set my hand and seal this eight and twentieth day of September in the fifth year of our Sovereign Lord King George over Great Britain etc Anno Dm 1718
