This is the last Will and Testament of me Samuel Akehurst of Brighton in the County of Sussex, Gentleman. First I direct my just debts and funeral and testamentary expences to be paid by my Executors hereinafter named as soon as conveniently may be after my decease and for as my two sons Samuel Akehurst and William Henry Akehurst have already been amply provided for by me in various ways and at various times during my life I consider that I cannot in justice to the other members of my family make any bequest or disposition in their favour other than the contingent bequest hereinafter mentioned.
I direct authorize and empower my Executors or Administrators for the time being as soon as conveniently may be after my decease to sell and dispose of all my copyhold messuages or tenements, land and hereditaments whatsoever and wheresoever and either by public auction or private contract as they shall think proper. And I direct my said Executors and Administrators for the time being to stand possessed of the monies to arise therefrom in aid of my personal estate. I give devise and bequeath unto my wife Catherine Akehurst, my daughter Fanny Akehurst and my son-in-law William Reason of Brighton aforesaid School Master their heirs Executors administrators and assigns all my messuages, lands, tenements, hereditaments and real estate whatsoever and wheresoever and also all my personal estate and effects whatsoever and wheresoever to hold the same to them the said Catherine Akehurst, Fanny Akehurst and William Reason their heirs Executors Administrators and assigns according to the respective natures tenures and quality thereof but upon the several trusts following (that is to say) upon trust to sell dispose of collect call in and convert into money the whole of my said real and personal estates in such manner as they or the survivors or survivor shall in their discretion think proper and to stand possessed of and interested in the monies to arise therefrom and from the sale of my said copyhold hereditaments upon trust in the first place to pay thereout all my debts funeral and testamentary expences and also all mortgages and other incumbrances in any way affecting my said real or personal estates and all expences attending the sale or conversion thereof and to lay out and invest the residue of the produce of Saml. such sale or sales as aforesaid in their joint names in the public stocks or funds of Great Britain or upon real security in England at interest And to stand possessed of and interested therein upon trust to pay the interest dividends and proceeds thereof unto my dear wife Catherine Akehurst and her assigns for and during the term of her natural life And from and immediately after her decease then upon trust during the joint lives of my daughter Elisa Akehurst the wife of the said William Reason and the said William Reason to pay the interest dividends and proceeds of one moiety or half part of the said stocks funds and securities unto such person or persons as she my said daughter Elisa Reason by any writing signed by her own hand shall from time to time notwithstanding coverture and independently of the said William Reason direct or appoint And in default of such direction or appointment into the proper hands of the said Elisa Reason for her own sole and separate use and benefit so as that the same or any part thereof shall not be subject or liable to the debt control or engagement of the said William Reason and for which the receipt of receipts of her my said daughter Elisa Reason signed with her proper hand or of such person or persons as she shall appoint to receive the same as aforesaid (but not by way of anticipation) shall from time to time be a good and sufficient discharge and after the decease of either of them the said William Reason and Elisa Reason then I direct my trustees and Executors and Administrators for the time being their Executors Administrators and assigns to assign transfer and set over the said moiety of the said trust monies stocks funds and securities unto the survivor of them the said William Reason and Elisa his wife his or her Executor Administrator and assigns for his or her own absolute use and disposal And I direct my said Trustees Executors and Administrators for the time being their Executors Administrators and assigns to stand possessed of and interested in the remaining moiety or half part of the said stocks funds and securities from and after the decease of my said wife Catherine Akehurst Upon trust to pay assign transfer and set over the same unto my said

daughter Fanny Akehurst (if she shall then be living) and her Executors Administrators and assigns absolutely But in case she shall then be dead and have left issue her surviving then I direct my said Trustees and Executors and Administrators for the time being their Executors, Administrators and assigns to pay assign and transfer the said moiety of the said stocks funds and securities unto and amongst such issue equally to be divided between them share and share alike as and when they shall severally attain the age of twenty one years and the interest thereof in the meantime to be applied for their respective maintenance education and support But in case my said daughter Fanny Akehurst shall be dead at the time of the decease of my said wife and have not have left any issue her surviving then I direct my said Trustees and Executors and Administrators for the time being their Executors Administrators and assigns to pay assign transfer and make over such last mentioned moiety of the said stocks funds and securities unto my two sons Samuel Akehurst and William Henry Akehurst and their respective Executors Administrators and assigns equally to be divided between them share and share alike provided always and I do hereby will and declare that if my Trustees and Executors or Administrators for the time being their Executors Administrators and assigns shall think it more advisable to defer the sale of my said freehold leasehold or copyhold estates or any part thereof than to sell the same immediately after my decease it shall and may be lawful and I do hereby authorise and empower them to so defer the same so long as they shall think proper and in the meantime to apply the rents and profits thereof (after making due allowance for taxes and repairs and paying the interest of any mortgage, debts, ground rents and other incumbrances and charges affecting the same) to and for the same intents and purposes as the interest of the money to arise by the sale thereof would be applicable to Provided also and I do hereby authorise and empower my Trustees Executors and Administrators for the time being their Executors Administrators and assigns if they shall think fit previously to the sale of all or any part of my said Copyhold Saml. Freehold or leasehold estates by any deed or deeds to be by them legally executed from time to time to grant any lease or leases in possession but not in reversion or remainder or by way of future interest of my said freehold copyhold or leasehold estates or any part thereof to any person or persons whomsoever for any term or terms of years not exceeding twenty one years so as no such lease or leases be made dispunishable of waste and so as there be reserved therein the best and most improved yearly rent that can be obtained for the same without taking any fine or premium for the same And I appoint my said wife Catherine Akehurst my said daughter Fanny Akehurst and my said son-in-law William Reason Joint Executors in trust of this my Will And I declare that the receipt or receipts in writing of my Executors or Administrators for the time being for any monies to arise by the sale of my real or personal estates shall be effectual discharges to the purchase as thereof and that such purchasers shall not be responsible for the application of the same. And further that my Trustees and Executors and Administrators for the time being their Executors Administrators and assigns shall not be answerable for the acts deeds or defaults of each other nor for any money which shall not come to their respective hands nor for any loss or damage that may happen to the said Trust monies and premises unless the same shall happen through their own respective wilful neglect or default And I also authorise and empower them my said Executors Administrators and Trustees for the time being their Executors and Administrators to deduct and retain out of the said Trust monies all such expenses that they shall incur in or about the performance of this my Will or the Trusts thereof or of any wise relating thereto
Provided also and I do hereby direct that in case any Trustee or Trustees hereby appointed or any future Trustee or Trustees to be appointed as hereinafter mentioned shall die or desire to be discharged from or decline or become incapable to act in the Trusts aforesaid then and so often as the same shall happen it shall be lawful for the acting or continuing Trustee or Trustees by any Deed or Deeds to appoint some other person or persons to be a Trustee or Trustees in the place and stead Saml. of the Trustee or Trustees so dying, desiring to be discharged from or declining or becoming incapable to act as aforesaid and that upon every such appointment the said Trust estates and premises shall be assigned and transferred in such manner and so as that the same may be effectually vested in the new Trustee or Trustees either solely or jointly with the other Trustees or Trustee as the case may require And that every such new Trustee shall have and be invested with such and the same powers authority and discretions to all intents and purposes whatsoever as if he had been originally appointed by this my Will And I revoke all former Wills by me made In testimony whereof I the said Samuel Akehurst the Testator have to this my last Will and Testament contained in five sheets of paper subscribed my name the thirteenth day of June one thousand eight hundred and forty two.
