    In the name of God amen I John Akeherst of Hellingly in the County of Sussex yeoman being weake in body but of sound and perfect mind and memory praise be to God for the same doe make and declare this my last Will and Testament in manner and form following: First of all I resign my Soul into the hands of God who gave it me hoping thro' the meritts and intercession of my Saviour Jesus Christ, to obtain remission of all my sins, ever trusting in the salvation. And my body I will be decently buried at the discretion of my Executrixes hereafter named and as for the Worldly Estate wherewith it has pleased Him to bless me, I dispose of that as follows: I will and bequeath unto my wife Frances the bedd and stedle with the curtains, coverlets, blanketts and all other things thereunto belonging as it now standeth in the kitchen chamber and which I usually lye on and also two pair of sheets, one pair of which of the finest sort, two pair of pillowcoats, one dozen of huckleback napkins with two towells and tablecloth of the same sort, one pottage pott, one spitt, one iron kettle, warming panne, one great iron skillett, one dripping pann, two pieces of pewter, two Firkins, a close stool and a brass skillett, all which household goods shall be delivered to my said wife within one month after my decease. And further my mind and will is that my youngest daughter Jane shall have, after my decease, one quarter of a years boarding without paying anything for the same. Item I give to my daughter Joan, one silver cupp or bowl. Also I give unto my son in law Edward Fricker my clock with the case. Also I give unto my grandson William Medhurst all my wearing apparrell. Also I give unto my two daughters Mary and Jane the two best bedds in the hall chamber with the sheets, curtains and all other things to them belonging. Item I give unto my said daughters Mary and Jane one hundred and Fifty pounds a piece to be paid within six months after my decease. The rest and residue of all my other personall estate my debts, legacies and Funeral expenses being first satisfied and discharged, I will to be equally divided between all my six daughters and alsoe my Farme in Hellingly called Akeherst, which I give to them to be sold and the money equally divided between them. But my mind and will is that my daughter Katherines share of the personall estate and said Farm shall be ordered and disposed of by my two loving Friends Mr John Newington of Ripe and Mr Richard Day of Hadlow in Mayfield and they in their judgement and conscience shall believe to be most for the good and benefit of my said daughter Katherine It being in my mind that my son in law Thomas Day shall have none of it come to his hands for disposall and my mind and will further is that what share of my personal estate shall fall to my daughter Elizabeth shall goe to the paying off a mortgage on severall pieces or parcells of land lying in Sutton and Seaford which her husband purchased off Mr Hawes, Minister of Berwick In case her husband shall settle the said lands on my said daughter Elizabeth his wife and her children in settlement as shall be satisfactory to my aforesaid two friends. But in case he refused soe to do, then I give them the power to manage her share in the same manner as I have empowered them to doe for the benefitt of my daughter Katherine and her children. Further my mind and will is that my son in law Edward Hook shall come to dwell in the house where I now live and shall enjoy the lease of that and of the lands thereunto belonging and all other, the upland and marsh grounds of which I have lately taken a new lease of Mr Mawson in consideration of the benefitt which I hope he will reap thereby he shall for every year of the lease that shall at the time of my death, be unexpired pay unto my five daughters, Elizabeth, Mary, Ann, Katherine and Jane, four pounds a piece yearly and shall likewise pay for mindiment chalk and appeles and for wood and Fagotts cut down what two indifferent persons shall think reasonable. I doe appoint my daughters exempting Katherine, to be joynt executrixes of this my last Will and Testament and my aforesaid loving Friends Mr Newington and Mr Day, overseers of the same desiring them to assist in the disposing of my stock and other goods and to each of them I give a guinea and my mind and will is that if any difference happens to arise between any of the persons mentioned in this my Will concerning my estate, or the true intent and meaning of this my Will, such difference shall be absolutely determined by the award of my neighbour Worger of Grovebridge and any other person or persons by him made thereof for judging of the same to whose award for the prevention of any suit in Law they shall be obliged to stand and I doe hereby revoke and disannull all former Wills by me made. In witness whereof I have to this my last Will and Testament, sett my hand and seale this 20th day of August in the year of our Lord 1709 (the marke of John Akeherst signed, sealed, published and declared to be the last Will and Testament of the Testator those words given them to, estate, the money. It being my mind that my son in law Thomas Day shall have none of it come to his hands excepting Katherine being first interlined in the presence of the marks of Susan Akeherst, James Bristed and Mary Armitage.

Richard is a beneficiary of Sarah's brother Joseph Akehurst's will proved 1810 leading one to assume that he was related of the Akehursts of Beddingham. Sarah'a age is right (bap. 28 Jun 1752 at Beddingham) and she married John Henty on 10 Nov 1773 at Beddingham, just over one year after the birth of Richard. There doesn't seem to be another female Akehurst in that family that fits.

    Description: AKEHURST John, wife Mary; John 10 and twin sister Mary, Thomas 8, Elizabeth 7, Lucy 6, William 4, and an infant; JPs? order removing them from Pevensey to Hooe confirmed subject to the opinion of King?s Bench on the case: the pauper was originally settled in Hooe and occupied a house owned by John POCOCKE, rent £4 p.a of which the parish paid 40s at Lady Day 1801; the pauper took a holding at Pevensey of John POCOCKE with certain rights of common annexed to it at a rent of £33 p.a but the pauper did not know the extent of the rights and he occupied the house for a few days after Lady Day 1801 until the removal; because i[t was a time of scarcity, Hooe continued to pay relief for 6 months after the pauper removed to Pevensey; pauper was unable to purchase cattle to turn out on the common ?[more].
  • Anecdote*: Possible burial on 10 Sep 1805 at Hastings All Saints where his son John and family were to live. Name given as "John Aker".3

    This is the last will of me Hannah Akehurst of Hastings in the county of Sussex widow I appoint Thomas White of Hastings aforesaid grocer and Edward Thomas Burchall Austin of the same place solicitors clerk to be the executors and the trustees of this my will and I give to them all my property in trust to convert the same into money by sale or otherwise and to divide the proceeds (after paying thereout my funeral and testamentary expenses and debts) among the following children of mine namely George, William, Ann the wife of Edward Elphick, Mary, Edward Thomas, Jane the wife of William Goodman Porter and Alfred in equal shares In witness whereof I have hereunto set my hand this twenty eighth day of January one thousand eight hundred and eighty four.

    This is the last Will and Testament of me John Akehurst in the County of Sussex, Bricklayer.
    First I constitute and appoint my dear wife Elizabeth Akehurst and my friend Charles Booth of Hastings aforesaid Carpenter Executrix and Executor of this my Will and I direct them to pay and discharge all my just debts and funeral and testamentary expenses as soon as conveniently may be after my decease. I give and devise all my messuages, lands, tenements, hereditaments as well as freehold and copyhold and all of my other real estate whatsoever and wheresoever unto and to the use of the said Charles Booth his heirs and assigns forever upon trust during the life of my said wife Elizabeth Akehurst that he the said Charles Booth his heirs or assigns do or shall permit and suffer my said wife Elizabeth or her assigns to receive and take the rents issues and profits thereon to and for their own use and benefit and from and after the decease of my said wife in Trust for my said son Thomas Akehurst his heirs and assigns forever Provided always and I do hereby declare that in case it shall be considered advantageous for my Estate to sell and dispose of all or any part of my said real estate during the lifetime of my said wife, it shall be lawful for the said Charles Booth his heirs and assigns and I do hereby authorise and direct him or them at his or their discretion with the consent of my said wife during the minority of my said son after he shall have attained the age of twenty one years with the consent of my said wife and son to sell and dispose of all or any part of my messuages, lands tenements, hereditaments and real estate together or in parcels and either by public auction or private contract for such price or prices as can be reasonably obtained for the same and to pay apply and dispose of the monies from such sale or sales arising for the same manner and for the same purposes as I have hereinafter expressed and directed of and concerning the residue of my personal estate And I do hereby
    Declare that the receipt or receipts of my Trustee or Trustees for the time being shall be a good and sufficient discharge to the purchaser or respective purchasers of my said hereditaments and real estate and any part thereof respectively for his her or their purchase money or respective purchase monies or for so much thereof as in any such receipt of receipts shall be expressed to be received And that such Purchaser or Purchasers shall not afterwards be answerable or accountable for the loss misapplication or nonapplication

I give and bequeath all the rest and residue of my monies, securities for money, goods, chattels and personal estate whatsoever unto the said Charles Booth his Executors Administrators and Assigns upon trust to pay to or permit and suffer my said wife Elizabeth to receive and take the interest, dividends and proceeds thereof for her own use and benefit for and during the term of her natural life And from and after her decease Upon Trust to pay and transfer the said residue of my personal estate or the stocks, funds or securities in or upon which the same shall be invested unto my said son Thomas Akehurst for his absolute use and benefit or in case the said Thomas Akehurst shall be then dead and left issue then living Upon Further Trust to pay distribute and divide the same unto and equally between all and every child and children lawfully to be begotten by my said son who shall be then living and the issue of any such child or children who shall be then dead and have left issue, in equal shares and proportions as and when suck child or children and issue respectively shall attain the age of twenty one years but the issue of any such child or respective children then dead shall take equally amongst them, if more than one the share or shares to which his her or their parent or respective parents would have been entitled if living and no more Provided Always that in case my said son Thomas Akehurst shall die during the lifetime of my said wife and leave no lawful children or issue who shall be living at the time of her decease then I authorise and direct my said Trustee or Trustees for the time being to sell and dispose of my said real estate in manner hereinbefore directed or such part thereof shall not have been previously sold in pursuance of the power hereinbefore in that half contained and to stand professed of the monies thereof arising and also of the residue of my personal estate Upon Trust to pay the interest, dividends and annual proceeds thereof unto my brother Thomas Akehurst during his natural life And from and after the decease of my brother Thomas Akehurst Upon Trust to pay distribute and divide the said monies and residue of my personal estate unto and equally between all and every child or children of my said brother Thomas Akehurst lawfully begotten and to be begotten who shall be living at the time of his decease and the issue of any such child or children who shall be then dead and have left issues in equal shares and proportions as and when

    Such child children and issue respectively shall attain the age of twenty one years But the issue of such child or respective children then dead shall take only such share or proportion or shares or proportions as his her their parent or respective parents would have been entitled to if living and no more. And, I empower my Executors and Trustees for the time being to invest and place out at interest in or upon any Government or real securities all such sums of money shall come into his or their hands by virtue hereof and from time to time to reinvest or replace the same at interest on other securities of a like nature. And I declare that my said Executors and Trustees for the time being shall not be answerable or accountable for the acts deeds or defaults of each other (the joining in receipts for conformity not withstanding) nor for any loss that may happen by the failure or deficiency of securities or by any other ways or means whatsoever without his her their respective wilful neglect or default. And further that it shall be lawful for my Executors and Trustees for the time being to deduct and retain out of my said estate all such costs charges and expenses as they ort he shall respectively pay and be put unto in the performance of this my Will or of the Trusts thereof.
    And Lastly, I revoke all former Wills in witness whereof, I the said John Akehurst the Testator have to this my last Will and Testament contained in three sheets of paper set my hand and seal that is to say my hand to the first two sheets thereof and my hand and seal to this the third and last sheet thereof this twenty second day of April in the year of our Lord, one thousand eight hundred and thirty nine.
