- Anecdote*: I have shown Ann's marriage to Walter as c1675 but this may be wrong. The marriage to Ann may be later as a possible marriage occured on 30 Mar 1714 when a Walter Burt married Anne Peacock at Streat. This looks a possibility given their daughter Alice Burt married Thomas Buckwell at Streat also. If the later marriage is correct then there is an earlier marriage yet to be found.

The will of James Burt late of Cuckfield within the Archdeaconry of Lewes yeoman deceased was proved the thirtieth day of May in the year of our Lord one thousand seven hundred and eighty before the Reverend Peter Guerin Crofts Clerk Surrogate and so forth, Upon the oath of Mary Stedman the only Executrix in the said will named To whom was committed the administration of the goods etc being first sworn well and faithfully to administer the same and so forth And also that the goods etc of the said deceased do not amount unto one hundred pounds

In the name of God Amen I Walter Burt of Wivelsfield in the county of Sussex tanner being weak in body but of sound and perfect mind and memory praised be God for the same and calling to mind the uncertain estate of man and that all flesh is as grass and must yield to death at one time or other and being sensible of the same do hereby make my last will and testament and First and principally I commit my soul to God who gave it hoping to have a blessed resurrection and through the merits of Jesus Christ my saviour and Redeemer to have all my sins pardoned and done away and my body I commit to the earth to be decently buried at the discretion of my Executors hereafter named And First I will that all those debts that I owe in right or equity be honestly paid within convenient time after my decease And As for what portion of the world God has been pleased to bestow upon me I will and bequeath in manner and form following (that is to say) I will and bequeath unto my youngest son Walter all my land tenements and hereditaments lying and being in Roffey Street in the parish of Horsham in the county of Sussex now in the tenure and occupation of one Francis Currington or his assigns to have and to hold the same messuage lands and premises with all and every the appurtenances to him the said Walter and his heirs forever but if my said youngest son Walter shall happen to die before he shall attain the age of one and twenty years then my mind and will is that the said lands and tenements in Roffey aforesaid shall be equally divided between my two daughters Elizabeth and Ann and if either of them shall die before they shall attain the age of one and 20 years then the survivor to have all the said lands and their heirs forever Item I give unto my said daughters Elizabeth and Ann the sum of £100 apiece to be paid to each of them when they shall attain their respective ages of one and twenty years or day of marriage which shall first happen and if any of them shall die before their said portions shall become due then my mind and will is that the survivor of them shall have all the others portion which said £200 for portions for my said daughters is to be raised out of my goods and chattels All the rest of my goods and chattels credits and ready money when my debts and legacies are paid and funeral expenses are paid and this my will proved I give and bequeath unto my youngest son Walter and his heirs and if my said son Walter shall happen to die before he attain the age of one and twenty years as aforesaid then my mind and will is that that part or portion which shall arise to him out of my stock goods and chattels shall be equally divided between my said two daughters or to the survivor of them But if it shall happen that both my said two daughters shall die before their legacies shall become due that then my mind and will is that all their portions shall be to the only use and behoof of my said son Walter and his heirs forever and my mind and will is that my loving wife shall have the tuition of my said children with the use of their portions for bringing them up provided she continue a widow but if my said loving wife shall happen to marry again then my mind and will is that my Executors hereafter named shall if they please have the tuition of my said son sons John Walter Elizabeth and Ann with the interest of their portions for the bringing them up till they shall attain their respective ages as aforesaid Item I give unto my eldest son John my lands call Nashland and Moreland at Staplefield to have and to hold the same to him and his heirs forever and I do hereby make my loving father and my brother William joint executors to this my last will and testament and doe give them 10 shillings apiece to buy each of them a ring and their reasonable charges to be allowed them in the discharging of this their executorship and I do hereby declare this to be my last will and testament annulling all former wills and testaments In Witness whereof I the said Walter Burt have hereunto set my hand and seal this five and twentieth day of November and in the 13th year of of the reign of our sovereign Lord William the third Anno Dm 1701
