    This is the last Will and Testament of Me John Akehurst of Wartling in the County of Sussex, Yeoman. First I order and direct that my just debts funeral and testamentary expenses shall be paid and discharged by my Executrixes hereinafter mentioned as soon as can be conveniently done so after my decease. I give and bequeath all my monies, securities for money, my live and dead farming stock, household furniture, goods and chattels and personal estate of whatever sort or kind unto my Executrixes hereinafter named. Upon Trust that they my said Executrixes do and shall permit and suffer my dear wife Ann Akehurst if she shall think fit to carry on my farming business as long as she pleases and retain my farming stock and utensils in carrying on such business and to permit my said dear wife to receive the interest dividends and annual produce of my personal estate and use my household furniture and effects for and during the term of her natural life provided she shall so long remain my widow but not otherwise and provided she becomes responsible for the amount of the said live and dead stock and farming utensils and from and immediately after the decease or second marriage of my said wife which shall first happen. Upon trust, to sell, call in, pay, assign, transfer, distribute and divide my said personal estate or the funds or securities in or upon which the same shall be invested unto and equally between and amongst my children namely Mary Akehurst, Jane Akehurst, Charlotte Akehurst, Naomi the wife of Thomas Pullinger of Ticehurst in the County of Sussex, Wheelwright, Orpha the wife of Thomas Crowhurst of Wartling, Farrier, and Emily Akehurst or such of them as shall be living at the time of my decease and the issue of such of them as shall be dead leaving issue in equal shares and proportions in case and as they shall severally attain the age of twenty one years. The issue of such child or children as shall be dead leaving issue then living to be entitled to and to receive (if more than one) equally amongst them, the share to which the parent of such respective issue would have been entitled to if living and no more and to become entitled to a vested interest therein and when and as soon as the parent of such respective issue would have been entitled to if such vested interest and in case any of my said children or issue shall die without leaving issue before his, her or their share or respective shares shall become an interest vested in him, her or them respectively, then the share or shares

    of him, her or them dying, shall go and be paid unto the survivors or survivor, or other or others of such children or issue respectively per stirpes in manner and in the proportions aforesaid when and as his, her, or their original share or shares shall become due and payable, provided always and my will is and I do hereby empower my Executrixes hereinafter named and the survivor of them and the Executors and Administrators of such survivor as occasion requires them to invest and place out at interest in or upon any of the public stocks or funds or in or upon such real security or securities as they or the survivor shall think proper all or any sum or sums of money which shall come into their or either of their hands or power in the performance or execution of this my will or by means or reason thereof and from time to time to sell out, call in or reinvest or replace the same at interest in manner aforesaid as may be deemed expedient and I declare that my Executrixes hereinafter named or the Executors or Administrators of either of them shall not be answerable or accountable for the acts deeds or defaults of each other (the joining in of receipts for conformity not withstanding) nor for any loss that may happen by the failure of securities or by any other ways or means whatsoever without their and her wilful respective neglect or default. And I further authorize and empower my Executrixes and the Survivor of them and the Executor or Administrator of such survivor to deduct and retain to themselves, himself and herself respectively out of the said Trust premises all such costs, charges, damages or expenses as they or either of them respectively shall pay, expend, sustain, or be at or put unto in or about the performance and execution of this my Will or the Trusts hereof or in anywise concerning the same. And I hereby authorize and empower my Executrixes or the survivor of them and the legal personal representative of such otherwise to apply the interest or dividends or annual produce of any minor’s share who may be entitles to any share of my personal estate under this my Will for and towards his, her or their maintenance and education during his, her or their minority or minorities in such manner as my said personal representative or representatives shall see fit. Lastly I do hereby constitute and appoint my dear wife Ann Akehurst and my said daughter Mary Akehurst joint Executors of this my Will and hereby revoking all former Wills by me at any time heretofore made.

    This is a Codicil to be annexed to and taken as part of the last Will and Testament of me John Akehurst of Wartling in the County of Sussex, Yeoman, bearing date the twenty sixth day of June one thousand eight hundred and forty four.     The Will and Codicil of John Akehurst late of Wartling within the Archdeaconry of Lewes, Yeoman, deceased which were proved on the eighth day of May in the year of our Lord one thousand eight hundred and fifty five by John Trill one of the Executors therein named with power reserved of granting the like commission to Ann Akehurst and Mary Akehurst, the other Executors named in the said Will (see Register 207) were again proved on the twenty seventh day of August in the year of our Lord one thousand eight hundred and fifty five before the Reverend Anthony Nott, Clerk Surrogate and so forth upon the oaths of the said Ann Akehurst and Mary Akehurst, to whom was committed the administration of the goods etc. of the said Testator jointly with the said John Trill they being first sworn well and faithfully to administer the same and so forth. And as the goods be unadministered aforesaid were under the value of three thousand pounds.

    In the name of God Amen I John Akehurst of [blank] Gent being sick in body but of sound and perfect mind and memory praise and thankes be therefore given unto Almighty God for the same considering with myself the mutabillity of this life & the certainety of death although the time and hour thereof be altogeather uncertaine and to the end and intent to be the better prepared and settled in mind whensoever it shall please the Lord to take me out of this transitory life I doe therefore by Gods permission make and declare this my Testament wherein is conteyned my last will in manner and forme following (that is to say) First and principally I commend my soule into the hands of Almighty God my maker and preserver hoping and assuredly believing by and through the most precious death passion and resurrection of Jesus Christ his sonn my onely [Saviour] and Redeemer to be saved and to have free pardon remission & forgiveness of all my sins and inequities and to inherite Everlasting life in the Kingdome of Heaven amongst the Ellect resting confident thereof in the meane time until the dissolution of my body bee the blessed and conformable Spirit of God the Holy Ghost and my Body I doe commit to the Earth from whence it came in hope of a joyfull resurrection at the last day when both my body and soule shall be reunited and enter into Everlasting happiness my body to the Earth to be buried at the discretion of my Executors hereafter named according as they shall thinke fitt and as touching the ordering and disposing of all such temporall Estate as it hath pleased God of his infinite mercy to bless me withal I doe will give devise limit and appoint the same in manner and forme following (that is to say) First I give to my two Nephews Samuell Mason and Joseph Mason all those my Messuages Lands and Tenements called or knowne by the name of Akehurst and Kenwards sciutate lying and being in the parish of Hellenly in the County of Sussex and also that house and Land lying and being in Wardbilton called or known by the name of Steel Forge scituate and being in the County of Sussex and them and their heires for ever chargeable with the payment of the Legacies hereafter by me given they my two Nephews paying to my Sister and their Mother twenty pounds which I give her as a Legacie Item I give and bequeath unto my Cozen Thomas Newington the summe of twenty pounds Item I give and bequeath unto Elioner Davies the wife of Edward Davies the summe of forty pounds both the two last mentioned Legacies herein by me given I will and appoint the same to be paid out of the yearely rents issues and profits of my said Messuages Lands and Tenements herein before given and my will and mind is that my Executors hereafter named shall have and enjoy all my Messuages Lands and Tenements lying and being in the parish of Hellenly in the County of Sussex together with all that house and land lying and being in Wardbilton in the County of Sussex aforesaid herein before bequeathed and given unto my Nephews Samuell and Joseph Mason and to their heires forever and shall have take and receave the rents issues and profits of the same Messuages Lands and Tenements until they my Executors shall be fully satisfied and paid the Legacies herein before bequeathed to them and my will & meaning is that the Legacies of twenty pounds herein before given & bequeathed to my sister shall be paid out of my Messuages Lands & Tenements herein before bequeathed unto my Nephewes Samuell and Joseph Mason by them within three yeares next after the decease of me Item I give and bequeath all my woods and underwoods growing and being in and upon any my Messuages Lands and Tenements herein before given unto my Executors hereafter named and I do will nominate and appoint Thomas Newington and Elionar Davies the wife of Edward Davies my full and sole Executors of this my last will and Testament making void and null all former and other wills by me make and doe make and declare this to be for and as my last will and Testament In Witnesse whereof I have to this my last will and Testament contained in five sheetes of paper to the fifth and last sheete have set my hand and seale this three and twentieth day of August in the fith yeare of the reigne of their Majesties William and Mary of England etc King and Queene Anno Domini one thousand six hundred ninetie three the name of John Akehurst Signed sealed published and declared by the said John Akehurst to be for and as his last will and Testament in the presence of Wm Damsell Edw Sharp the marke of Margaret Lee Rich Forbett Cler to Mr Clement Scriv
